The Terms were drafted in English (US). In the event of any discrepancies between a translated version of this agreement and the English version, the English version prevails.

The Summary

It is important to read these terms and conditions thoroughly, as they apply each time you use Mago. They constitute our service terms that govern interactions with Mago, including its brands, products, and services, collectively referred to as "Mago Services" or "Services". By accessing or using the Mago Services, you agree to these Terms. For a brief overview of the key points:

1.You must be 18 or older to use Mago Services.

2.We are not liable for your posts or statements on Mago, nor do we monitor the app's content, but we may remove any content we deem inappropriate if alerted.

3.For concerns about your data use, refer to our Privacy Policy, which outlines how we handle and protect your personal data. By using Mago, you consent to the use of your data as described in the Privacy Policy.

4.You agree not to use Mago for any illegal, misleading, harmful, or discriminatory activities.

Mago is a free social app providing network chat and live broadcasting services. You agree to use Mago in accordance with its intended purpose and these terms and conditions.

The Terms apply whenever you use Mago, regardless of registration status. By accessing, using, registering for, or receiving services on Mago (the "Services"), you accept and agree to be bound by these Terms.

IF YOU DO NOT ACCEPT AND AGREE TO THE TERMS, YOU MUST NOT ACCESS OR USE THE APP OR SITE.

1.Privacy

Your privacy is crucial to us. Our Privacy Policy outlines how you canshare your information on Mago and how we collect and use your content. We encourage you to review the Privacy Policy to make well-informed choices.

2.Sharing Your Content and Information

You can post various types of content ("Content") on Mago. You retain ownership of all the content and information you upload, and you can manage its sharing through your "Privacy" and "Application Settings". However, there are guidelines to follow. When using Mago, do not post or transmit any content that:

(1). Contains offensive language or expletives that could harass, upset, embarrass, alarm, or annoy others;

(2). Is obscene, pornographic, or otherwise disrespectful to human dignity;

(3). Is abusive, insulting, threatening, or promotes or endorses racism, sexism, hatred, or bigotry;

(4). Encourages illegal activities, including terrorism, racial hatred, or other criminal offenses;

(5). is defamatory;

(6). Relates to commercial activities (such as sales, competitions, advertising, links to other websites, or premium phone numbers);

(7). Involves sending "junk" mail or "spam";

(8). Contains spyware, viruses, corrupt files, worms, or other harmful code intended to disrupt or damage software, hardware, networks, servers, or any other equipment, or any material designed to intercept or misuse data;

(9). Infringes upon any third party’s rights (including intellectual property and privacy rights);

(10). Depicts drugs or drug usage;

(11). Contains political content;

(12). Shows another individual without their consent;

(13). Includes any content deemed negative or unsuitable by Mago;

(14). Involves information or comments about individuals under 18 years old;

(15). While we value your feedback or suggestions about Mago, understand that we may use them without compensating you, and you are not obliged to provide them.

Please exercise good judgment when selecting the content you post or send via Mago, as you are solely responsible for and liable for such content.

3.Protecting Other People's Rights

We respect other people's rights and do our best to keep Mago safe, and expect you to do the same.

(1). You must not upload or take any actions on Mago that infringe upon others' rights or break the law.

(2). We reserve the right to remove any content or information you post on Mago if we determine it breaches these Terms or our policies.

(3). If we remove your content for infringing someone else's copyright, and you believe we removed it by mistake, we will provide you with an opportunity to appeal.

(4). If you repeatedly violate others' intellectual property rights, we may deactivate your account when necessary.

(5). You must not use our copyrights or trademarks, or any similar marks, unless explicitly authorized by us in writing.

(6). When collecting information from users, you must: get their consent, clearly state that you (not Mago) are collecting their information, and provide a privacy policy detailing what information you gather and how you will use it.

(7). You must not upload anyone’s identification documents or sensitive financial data on Mago.

(8). You must not tag users or send email invitations to non-users without their consent.

4.Registration and Account

Mago users required nick name, age, gender, avatar and other optional information, and we need your help to keep it that way. We provide three ways to access Mago, Facebook, Google and SMS. Here are some commitments you make to us relating to registering and maintaining the security of your account:

(1). You must be 18 years old or older to use Mago.

(2). You cannot transfer your account to anyone else without obtaining our written consent first.

(3). You are prohibited from providing any inaccurate personal details on Mago or creating an account on behalf of someone else without authorization.

(4). If your account is disabled, you are restricted to communicating only with our official support team, known as the "Mago Team," and cannot post any other content.

(5). We retain the right to delete or ban your account if we deem it necessary.

5.Termination

If you breach the Terms or otherwise pose a risk or potential legal liability for us, we reserve the right, at our sole discretion, to:

(1). suspend or revoke your registration (if applicable) and your ability to access or use Mago or submit any Content to Mago; and

(2). employ any operational, technological, legal, or other measures available to enforce the Terms (including but not limited to blocking specific IP addresses).

We will attempt (though are not obligated) to notify you if your access to Mago and/or your Profile is suspended or terminated.

If you have registered on Mago, you can end your registration at any time by navigating to the "Settings" control on Mago while logged in and selecting the "Delete Account" link. We retain your profile information in case you choose to reactivate your account later. Many users deactivate their accounts temporarily and expect us to keep their information until they return to Mago. Therefore, you can restore your account and profile in full within 30 days of deactivation. Once your registration is terminated, we have the right to remove any associated Content you have submitted or uploaded to Mago. For more information, please consult our Privacy Policy. Content you have uploaded to Mago, aside from your Profile (such as Moments, Comments, or Contacts), may still be visible on Mago after your registration is terminated.

6.In App Purchase and Subscription

In-App Purchases: Occasionally, Mago may offer extra products and services for purchase via the App Store℠, Google Play, or other app platforms ("in-app purchases"). If you decide to make an in-app purchase, you will be asked to provide details for your account on the mobile platform you are using (e.g., Apple, Android, etc.) ("your IAP Account"), and your IAP Account will be charged for the purchase based on the terms provided at the time of purchase, as well as the general terms for in-app purchases relevant to your IAP Account. If you buy a subscription with auto-renewal through an in-app purchase, your IAP Account will be billed on a recurring basis until you cancel according to the platform's terms. For more details, please consult the terms of your application platform related to your in-app purchases.

7.What can I buy on Mago?

Mago provides an option to pay for certain services available on the platform. Their VIP services offer various benefits, including opportunities to connect with additional individuals, customize your profile, and enhance your profile visibility to attract more users. You can purchase these VIP services after registering, with subscriptions available for different durations. Once you have paid for any VIP services, they are non-refundable. You may adjust your Auto Top-up at any time through your payment settings on your profile page. Pricing may fluctuate due to several factors, such as promotional deals, loyalty rewards, and other discounts that might be applicable to your age group.

8.How do I renew my VIP services with Mago?

Once you request Mago VIP Service, you authorize Mago to charge your selected payment method. To cancel or modify your payment method at any time, you can do so through the payment settings under your profile or by reaching out to your mobile service provider. If your payment method is through your mobile service provider, please review their payment terms, as these will dictate how payments to Mago are handled and how they can be altered or canceled. Your Mago VIP service subscription will automatically renew until you choose to cancel, and if you have enabled the auto top-up feature, your account will be automatically replenished until you decide to turn off this feature.

9.Subscription Tips


(1). Subscriptions will renew automatically unless the auto-renew feature is disabled at least 24 hours before the current period ends.

(2). The account will be billed for renewal within 24 hours before the end of the current period, and the renewal cost will be specified.

(3). Users can manage their subscriptions: auto-renewal can be turned off by accessing the Account Settings after purchase.

(4). Cancellation of the current subscription is not permitted during the active subscription period.

10.Virtual Currency

(1). Mago provides a feature that allows users to acquire virtual currency called "Mago Coins" for use within the Service (e.g., to "tip" another Mago Broadcaster during their live show or to send Gifts to friends in chat). You acknowledge that any distribution of Coins from your account, as a virtual "tip" to another user's account, is entirely at your discretion. Once you confirm a transfer of Coins to another user's account, it cannot be reversed, and the Coins cannot be withdrawn.

(2). Coins are virtual assets obtainable through online payments such as Credit Card, Debit Card, Bank Transfer, Wallet, Google Payments, iTunes Payments, and others. The value (exchange rate) of the Coins, the payment method, and any other conditions for acquiring Coins will be set by Mago according to your country of origin. Mago also reserves the right to adjust the purchase exchange rate between actual currency and virtual Coins at its discretion, with or without notice. By using the Service, you agree to the current exchange rate of any Coins at the time of your purchase.

(3). Coins purchased are to be used solely for legitimate purposes within the Service and must comply with all relevant laws. Coins cannot be exchanged or used for cash, property, or other economic benefits outside the services and Contents provided by Mago. The number of Coins needed for receiving services or Contents, and other terms related to the exchange of Coins, will be specified by Mago on the Platform.

(4). You acknowledge that purchasing Coins involves actual money, which must be obtained legally and without any dispute, and that it will not be connected to any criminal activity or proceeds now or in the future. If you disagree with any part of, or do not fully understand our exchange rate policy, or cannot ensure the legitimacy of your actual currency, please avoid purchasing or using Coins with the Service.

(5). You understand that Mago may alter, modify, or update these Terms of Use or the terms of sale related to Coins periodically, and such changes will apply to all future purchases of Coins. You agree to review these Terms of Use and any related terms before making any purchase.

(6). If Mago terminates your account for any reason, any remaining Coins in your account at the time of termination may be forfeited and will not be recoverable at Mago’s sole discretion.

(7). Coins will not be refunded or disputed under any circumstances; however, this does not apply if required by applicable laws and regulations. In such cases, Mago will determine the refund or dispute resolution process according to relevant laws and regulations, and this information will be provided on the Platform. Generally, if a refund or dispute request is made, the associated ID and Device will be permanently banned, and any diamonds generated from the Coins will be deducted.

11.Advertising/Promotions

Some Mago Services are financed through advertising revenue and might show ads and promotions. By using these services, you agree that Mago can place such ads and promotions within the Mago Services or around, alongside, or in connection with your Content. The nature, method, and scope of these ads and promotions can change without prior notice to you.

12.Abuse/Complaints

You can report any misuse or concerns about content on Mago. We offer both "Block" and "Report" features to help us maintain a clean and safe environment on Mago. To report a user, simply click "Report" on their profile and select the reason for your complaint. You can also report a moment by clicking "Report" on the moment’s detail page and choosing the reason for the report. All reports will be reviewed by our "Audit Team" who will take appropriate action based on our policies. If you believe an issue was handled incorrectly, you can appeal via "Feedback" at contact@magopro.com. We are committed to resolving any issues you may encounter with our service.


13.Proprietary Rights in Content on Mago


(1). Mago does not assert any ownership rights over the text, files, images, photos, videos, sounds, musical compositions, authored works, applications, or any other materials (collectively, "Content") that you submit via or through the Mago Services. By posting any Content on or through the Mago Services, you grant Mago a non-exclusive, fully paid, royalty-free, worldwide, limited license to use, modify, remove, add to, publicly perform, publicly display, reproduce, and translate such Content. This includes distributing part or all of the Site through any media formats or channels, except that Content marked as private will not be distributed beyond the Mago Services.

(2). You affirm and guarantee that: (i) you either own the Content posted by you on or through the Mago Services or have the necessary rights to grant the license described in this section, (ii) the posting and utilization of your Content on or through the Mago Services does not infringe upon the privacy rights, publicity rights, copyrights, contractual rights, intellectual property rights, or any other rights of any individual, and (iii) the posting of your Content on the Site does not breach any agreement between you and a third party. You agree to cover all royalties, fees, and other payments owed to any individual because of the Content you post on or through the Mago Services.

(3). The Mago Services include Content owned by Mago ("Mago Content"). Mago Content is protected by copyright, trademark, patent, trade secret, and other laws, with Mago retaining all rights to the Mago Content and the Mago Services. Mago grants you a limited, revocable, non-sublicensable license to reproduce and display the Mago Content (excluding any software code) solely for personal use related to viewing the Site and utilizing the Mago Services.

(4). The Mago Services feature Content from Users and other Mago licensors. Except as outlined in this Agreement, you are not permitted to copy, modify, translate, publish, broadcast, transmit, distribute, perform, display, or sell any Content available on or through the Mago Services.

(5). Mago carries out technical processes necessary to provide the Mago Services, including but not limited to transcoding and/or reformatting Content to enable its use across the Mago Services.

(6). Although the Site and other Mago Services are generally accessible, there will be times when the Site or other Mago Services may be interrupted for scheduled maintenance or upgrades, emergency repairs, or due to failures in telecommunications links and equipment beyond Mago's control. Furthermore, while Mago usually only removes Content that breaches this Agreement, Mago reserves the right to remove any Content for any reason, without prior notice. Deleted Content may be retained by Mago to meet legal obligations and cannot be retrieved without a valid court order. Therefore, Mago recommends that you maintain your own backup of your Content. In other words, Mago is not a backup service and will not be liable for any modification, suspension, or discontinuation of the Mago Services, or for the loss of any Content.


14.Disclaimer of warranties and limitation of liability

To the fullest extent allowed by law, Mago expressly disclaims:

(1). all conditions, representations, warranties, and other terms that might otherwise be implied by statute, common law, or equity law; and

(2). any liability incurred by you resulting from the use of Mago, its services, or these terms and conditions, including but not limited to any claims, charges, demands, damages, liabilities, losses, or expenses of any nature and however caused, whether direct, indirect, incidental, special, exemplary, punitive, or consequential damages (including those arising from negligence), loss of use, data, income, or profit, damage to property, wasted management or office time, breach of contract, or third-party claims, or any other losses of any kind, even if Mago has been notified of the potential for such damages or losses. This liability limitation covers issues such as transmission of disabling devices or viruses that might affect your equipment, failures in mechanical or electrical systems, communication disruptions (e.g., issues with your internet service provider), unauthorized access, theft, personal injury (except due to our negligence), property damage, operational errors, strikes, or acts of God related to Mago. This includes, but is not limited to, any loss of revenue, income, profits, contracts, business, anticipated savings, goodwill, data, wasted management time, and any other type of loss or damage, regardless of how it arises or whether it is foreseeable.


15.Indemnity

You agree to protect, indemnify, and hold Mago, along with its parent company, officers, directors, employees, and agents, harmless from any and all claims, damages, obligations, losses, liabilities, costs or debts, and expenses (including but not limited to legal fees) arising from: (i) your use of and access to the Mago Service; (ii) your breach of any term of these Terms of Service; (iii) your infringement of any third-party rights, including but not limited to copyright, property, or privacy rights; or (iv) any claim that one of your User Status Submissions has caused harm to a third party. This obligation to defend and indemnify will continue even after these Terms of Service end and after you cease using the Mago Service.


16.Legal Jurisdiction

This Agreement will be governed by and interpreted according to the laws of Hong Kong, disregarding principles of conflict of laws. Any disputes arising from or related to these terms, including any questions about their existence, validity, or termination, will be resolved through arbitration administered by the Hong Kong International Arbitration Centre (“HKIAC”) in line with the current Arbitration Rules of the HKIAC, which are considered incorporated by reference into this clause. The arbitration will take place in Hong Kong, and the proceedings will be conducted in English.

17.Amendments

We retain the right to modify these terms and will offer you the chance to review and provide feedback on the updated terms before you continue using our Services. We may notify you on the Website if we alter policies, guidelines, or other terms mentioned in or included by this Statement.
